Dans sa décision n° 2013-346, le Conseil constitutionnel a rejeté les griefs invoqués par la société Schuepbach Energy contre l’avis du Conseil d’État qui interdisait les forages utilisant la technologie de la fracturation hydraulique pour l’extraction de gaz de schiste. Les Sages ont jugé que les dispositions étaient conformes à la Constitution, fermant définitivement la porte à l’exploration et l’exploitation du gaz de schiste en l’état des seules techniques y afférentes connues.
Analysis of the decision of the Constitutional Council concerning hydraulic fracturing (fracking)
France’s Constitutional Council rejected the claims made by Schuepbach Energy company to oppose the directive of the State Council (Conseil d’État), which forbids drilling wells that use fracking technology for extracting shale gas. The “Wise Men” judged that the directive is in conformity with France’s Constitution, closing the door definitively for exploration and production of shale gas.
